Terms of Service

These Terms of Service ("Terms") govern your use of FFmpeg Micro, the website and API operated by Octetra, LLC ("we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Use of the Service

You may use our API and website only in compliance with these Terms and all applicable laws. You are responsible for the content and files you upload and must not use the Service for any unlawful or infringing purpose.

2. Accounts and API Keys

You must provide accurate information when creating an account. Your API key is personal to your account and must not be shared. You are responsible for all activity under your account or API key.

Accounts are intended for a single individual or a single organization. Use separate API keys to separate integrations, clients, or environments within one account. You may not use additional or successive accounts to obtain benefits that are provided once per customer, or to work around a limit, suspension, or closure that applies to you. We may consolidate, suspend, or close accounts we reasonably determine are being used that way.

3. Subscriptions and Billing

FFmpeg Micro offers Free and paid subscription plans through Stripe. Paid plans include a monthly token grant (see Section 4) and renew automatically unless canceled before the renewal date. All fees are non-refundable except where required by law. We may change the plans and prices we offer at any time. If a change affects your existing subscription, we will notify you in advance, and it will take effect no earlier than your next renewal date.

Billing and service emails are transactional. They tell you about charges, failed payments, plan and limit changes, and other facts about your account, and they are sent whether or not you have unsubscribed from our marketing email. There is no setting to turn them off, because they carry information you need in order to be billed fairly. Marketing and product emails are separate and every one of them carries an unsubscribe link. If you would rather not receive billing email at this address, you can change the email address on your account, or close the account as described in Section 10.

4. Tokens

Tokens are the unit we use to meter processing. Compute usage is deducted from your token balance per second of input processed, at the rates published on our pricing page. Tokens come from two sources, with different rules:

• Purchased tokens (one-time top-ups) do not expire while your account remains open.
• Grant tokens are included with paid subscriptions and credited each billing cycle. Unused grant tokens roll over while your subscription is active, up to three times your monthly grant. When your subscription ends, remaining grant tokens expire 7 days after the cancellation date.

All tokens are tied to your account: they have no cash value, are not transferable or redeemable for money, and are not refundable except where required by law. If your account is closed, whether by you or by us under Section 10, any remaining token balance is forfeited. Failed jobs are not charged, and charges for jobs that fail after being charged are automatically refunded to your balance.

5. Automatic Top-Up

Paid plans can enable automatic top-up. If you turn it on (at checkout or in your billing settings), you authorize us to automatically charge your saved payment method for the refill pack you selected whenever your token balance falls below your chosen trigger, up to the monthly spending limit you set, plus applicable tax. We email you a receipt for every automatic charge and notify you when a charge fails or your monthly limit is reached. You can change your trigger, refill pack, and monthly limit, or turn automatic top-up off entirely, at any time in your billing settings; changes take effect immediately.

6. File Retention

Uploaded input files are deleted after 7 days, and output files after 30 days. We are not responsible for retaining or recovering deleted data. Please download your processed files promptly.

7. Acceptable Use

• No illegal, infringing, or harmful content
• No attempts to bypass rate limits or abuse the API
• No reverse engineering or reselling the Service
• No interference with our systems or networks
• No creating multiple or successive accounts to obtain free minutes, tokens, credits, trials, or other benefits intended to be provided once per customer
• No circumventing, evading, or attempting to exceed usage limits, quotas, or account restrictions, including limits applied after a prior account was suspended or closed

8. Ownership and Content

You retain ownership of all files and content you process using the Service. We do not claim any rights over your data. By using the Service, you grant us a temporary license to process and store files as needed to provide the Service.

9. Service Availability

We strive to maintain uptime and reliability but do not guarantee uninterrupted service. We may suspend or modify the Service for maintenance, security, or legal reasons.

10. Termination

We may suspend or terminate your account if you violate these Terms or misuse the Service. You may stop using the Service at any time by deleting your account. When an account is closed, remaining token balances are forfeited as described in Section 4, and any active subscription stops renewing.

Where we close an account for a breach of these Terms, we may retain a one-way cryptographic identifier derived from the account's email address, for the sole purpose of enforcing that closure. It cannot be used to recover the address, and we do not use it for any other purpose. Closures you request yourself are handled as described in our Account Deletion policy.

11. Limitation of Liability

To the fullest extent permitted by law, FFmpeg Micro shall not be liable for any indirect, incidental, or consequential damages, including loss of data, profits, or use, even if advised of such damages.

12. Indemnification

You agree to indemnify and hold harmless FFmpeg Micro and its affiliates from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

14. Changes to Terms

We may update these Terms periodically. Continued use of the Service means you accept the updated version.
